Father Shoots at "Truck Thief," Kills Own Son Instead

Postby DamianaRaven » Thu Dec 28, 2017 10:29 pm

I absolutely HATE that they're calling this "an accident." This man very deliberately took the shot, thinking to wound or kill some other person who was stealing his truck. He says he was aiming for "the tailgate," which any truck owner (or anyone who's ever seen a truck) will tell you sits RIGHT BEHIND the driver. Why didn't he shoot for the tires? Who knows, but I have some pretty scathing ideas. (Tires are expensive to replace, while tailgate holes look AWESOME.) It's only the target's identity that was unintentional. This is really just a fucked-up, infuriating story that should serve as a cautionary tale against taking the Yosemite Sam approach to home security.

His name was Logan, which thankfully isn't The Doctor's real name. I hate it when bad things happen to people with familiar names! It chills me, like some kind of eerie omen.

article wrote:Trammell’s family says he was driving away from his parents home around 11:30 p.m. on December 24th in one of his father’s vehicles. His father was unaware that his son was borrowing his truck. Fearing the vehicle was being stolen, the family says he yelled out, firing a warning shot in the air in an attempt to get the driver’s attention, and then shot once at the tailgate to stop whomever was taking the truck.

For the record, shooting a fleeing car thief is an illegal use of lethal force. Once an intruder turns tail and runs, they no longer pose an immediate threat to your person, which is the only legal justification for lethal force. Shooting someone in the back in order to recover property they stole from you is not legal self-defense.

That being said, this apparently happened in rural Alabama. In rural jurisdictions (especially in the South), law enforcement tends to turn a blind eye to this sort of "self-help justice" or handle it with kid gloves for various practical and cultural reasons.

I think Texas came very close to passing some kind of law allowing citizens to use deadly force to defend their property.

Honestly, I don't really have a problem using force like that against a thief, but the real danger is collateral damage from firing the weapon at someone who is fleeing (see this situation as a case in point).

Shoot first, ask questions later. Got it. At least he doesn't have to worry about his son stealing any more cars.

I do. Only the most barbaric of cultures considers theft an immediately executable offense and usually they don't even care whether or not the "thief" is actually guilty. It's just an excuse to do what they really want, and that's to kill somebody.

The only valid excuses to kill a living being are as follows: it's threatening your life/safety, or you need its body to eat. Anything else is just for jollies.

Seems like a perfectly valid reason to me.

Where humans are involved, it's seldom (if ever) a legally valid reason.

Windy has a valid point on the inconsistency of those statements.

*nosebleed*

Wanting cops to do their jobs and not wanting them to shoot innocent people are ideals that are in conflict, how?
