There are at least some memes that are transformative enough to count as fair use, but there are definitely a ton that aren't.

Even if memes are deemed as fair use, it won't stop near blind automated content ID systems from proliferating. This is basically legislating to require them from large tech and they're not going to hire hundreds of people to curate content to check for infringing content.

It's not just Europeans who should worry about the blind automated system. YouTube, for example, already has problems with that where content creators get caught up and demonetized even when they are careful to follow all of the rules and their work is clearly fair use. They either need to not operate in Europe or get even stricter, which is going to be a problem for everyone on the platform.

And I am genuinely curious about the incentive behind not allowing platforms to show snippets of news articles without seeking a license. I am much more likely to go to the site and read the full article if I see a preview of it rather than a headline alone or link. Does that apply to blogs too or can Facebook show previews of AlexJonesIsMyHero dot com screeds for free but required to get licenses from BBC, CNN, etc? Or could they seek a license from, say, Fox news and not bother getting one from anyone else such that only Fox news articles get previews? Can someone who understands this better help me understand it please?

They're getting even more ridiculous in their policy now that a video with swearing in its first few minutes risks demonetization.
